Owen issued a Recommended Decision and Order (RDO) in the above-captioned case, recommending that the Illinois Labor Relations Board (Board) grant a petition filed by Service Employees International Union, Local 73 (Petitioner) concerning certain employees of the Illinois Secretary of State (Employer). Filed pursuant to Section 9 of the Illinois Public Labor Relations Act, 5 ILCS 315 (2010), as amended (Act), and Section 1210.170 of the Rules and Regulations of the Illinois Labor Relations Board, 80 Ill. Admin. Code, Parts 1200 through 1240 (Rules), the petition sought to clarify that a collective bargaining unit of Secretary of State employees previously recognized in Case No. S-UC-04-046, as modified by Case No. S-RC-11-006, includes Executive I and Executive II positions that exist outside of the Employer's Drivers' Services Department. The Employer filed timely exceptions to the RDO pursuant to Section 1200.135 of the Rules, and the Petitioner filed a timely response. After reviewing the record, briefs, exceptions, and response, we adopt the ALJ's recommendations for the reasons which follow.

 Description:  On September 21, 2010, the Illinois Labor Relations Board's Executive Director, John Brosnan, issued a Decision and Order in the above-captioned case directing that a bargaining unit certified in Case No. S-RC-10-216 be clarified to include the titles disputed in that earlier proceeding, namely, the part-time employee classifications in the Water and Wastewater Department and the Transportation Department of the Village of Mahomet (Employer). The Employer filed a timely appeal of the Executive Director's Decision and Order pursuant to Section 1200.135(a) of the Rules and Regulations of the Illinois Labor Relations Board, 80 Ill. Admin. Code Parts 1200 through 1240 (Rules), and the International Brotherhood of Teamsters, Local Union No. 26 (Petitioner) filed a response. After reviewing the record, the appeal and the response, we find the appeal without merit, and direct that the unit be clarified to include the petitioned-for part-time employee classifications.

 Description:  On August 25, 2010, Administrative Law Judge Elaine L. Tarver issued a Recommended Decision and Order in the above-captioned case in which she found that individuals employed by the City of Washington (Petitioner of City) in the classification of police sergeant were supervisors within the meaning of Section 3(r) of the Illinois Public Labor Relations Act, 5 ILCS 315 (2008) as amended Accordingly, the Administrative Law Judge recommended that the existing bargaining unit of sergeants and patrol officers, currently represented by the Policemen's Benevolent Labor Committee (Labor Organizations of PBLC) should be clarified as requested by the City to exclude the sergeants. Pursuant to Section 1210.170(e)(4) of the Rules and Regulations of the Illinois Labor Relations Board, 80 Ill. Admin. Code, Parts 1200 through 1240 (Rules), PBLC timely filed exceptions to the recommended decision to which the City filed a timely response. After reviewing the record, exceptions and response, we adopt the Administrative Law Judge's Recommended Decision and Order as modified below.
